First Generation

1. John Sullivan [804], son of Michael Sullivan Snr [1984] and Catherine Horegan [1090], was born about 1810 in Cork, Ireland, died on 16 Feb 1892 in Moolort, Vic, Australia aged about 82, and was buried on 18 Feb 1892 in Sandon, Vic, Australia.

General Notes: farmer. Death certificate states 12 yrs NSW, 39 yrs Vic.

John and his wife Julia (Leary)and Julia's brother Daniel Leary were all transported to Australia as convicts. Daniel Leary was married to Mary Sullivan and it is very likely that Mary Sullivan was the sister of John Sullivan, Julia's husband. I have research from the family of Daniel Leary and Mary Sullivan's family who still reside in New South Wales, Australia, although a definite link between Mary and John Sullivan has not been established.

John was tried at Cork on 12 December 1834 He was granted a ticket of leave in 1839 and was allowed to travel to Port Phillip District in the services of Mr. P.G.King for 4 months. He was then employed by Mr. McArthur at Yass and early in 1841 his Ticket of leave was endorsed as being transferred to Goulburn.

From shipping indent of Convicts on the ship BACKWELL-D.Dowson, Master, John Love Surgeon Superintendent, arrived from Ireland, September 30 1835:-Standing no of convict 35-2250 indent no 17 John SULLIVAN aged 23 could not read and write, Roman Catholic, married with 1 son and 1 daughter, born Cork, Labourer, offence-Assault and robbery. Tried at Cork on 12 December 1834, sentenced to 7 years with 3 months from former conviction. 5' 8" tall with a ruddy and a little pockmarked complexion, with Dark brown hair and blue to grey eyes. Particular . marks and features as follows:-Scar left side of forehead, another right eyebrow, scar above left cheekbone, another back of fourth finger of left hand, scar back of left thumb and forefinger, mark of a burn back of left foot, scar left corner of mouth.

According to the death certificate of John, he came to Victoria in about 1853. This date is different to the date given on his wife Julia's death certificate.

Family Lore suggests that this branch of the Sullivan's were related to the well known American boxer John L Sullivan 1858-1918 who was world Heavyweight Champion from 1882-1892. John was born in Roxbury, Massachusetts. More research needs to be carried out to ascertain if this information is correct.

Newstead
(from our own correspondent) Wednesday Evening
A case of fish poisoning occurred yesterday at the residence of Mr D Sullivan, of Joyce's Creek. Mr Sullivan, with his family and a nephew had partaken of tinned fish for dinner. About two hours afterwards symptoms of poisoning set in, and the family became so serious that a messenger was sent for Dr Macfarlane, who on arrival found the five occupants badly affected. They were treated, and all are now progressing favourably.

Mr John Sullivan (father of Mr D Sullivan) expired at the latter's residence yesterday morning, death being attributable to old age.

John married Julia Leary [805], daughter of Timothy Leary [1087] and Mary Ann Silk [1086], on 6 Feb 1832 in Roman Catholic, Killarney, Kerry, Ireland. Julia was born about 1811 in Cork, Ireland, died on 14 Jul 1872 in Captains Gulley Newstead, Vic, Australia aged about 61, and was buried on 16 Jul 1872 in Sandon, Vic, Australia. Another name for Julia was Julia O'Leary.

General Notes: Julia, her husband John Sullivan and her brother Daniel Leary were all transported to Australia as convicts.

From List of female Convicts by the ship ROSLIN CASTLE (4), William Richards, master, John Edwards Surgeon Superintendent , arrived from Ireland 25 February 1836. Standing no. of convict 164-36 ident no 52, Julia Sullivan aged 25, could not read or write, Roman Catholic, married with 1 son and 1 daughter, youngest 13 months old on board, born Cork, Housemaid and Laundry maid-offence, Stealing cotton from a shop, tried at Cork City on 19th February 1835, sentenced to 7 years with no prior convictions. Julia was 4' 11 1/2' tall with sallow complexion, brown hair and blue eyes. Particular marks or scars as follows:-scar right side of upper lip, scar on forehead (tattoos). JC upper left arm, several blue dots back of left hand, blue ring middle finger of same, six dots back of right hand, blue ring fore and middle fingers of same. Brother Daniel Leary, two years ago. Julia was assigned to Sophia Darcey in Sydney.

According to Julia's death certificate, Julia and John had been in Victoria for 14 years and in NSW for 13 years. This makes their arrival in Victoria around 1858 and according to these dates arrival in NSW would have been around 1845. As there is a birth of Daniel in NSW in 1841 with parents John and Julia Sullivan, the dates on the death certificate would seem to be somewhat underestimated.

Michael Sullivan, of Newstead, labourer filed at Castlemaine .

From Newstead Echo - Wednesday October 25, 1911
"The old residents of this district are passing away rapidly just now. The last to go was Mr. Michael Sullivan whose death took place on Friday. In his younger days he followed farming at Captains Gully, afterwards building a house on Castlemaine Road, in which he resided for the remainder of his days. He was a great sporting enthusiast, and owned several fair horses at different periods.

He also took a great interest in football and attended every match up to the last season. Although not in the best health, he was always bright and cheerful to within a year or so when his wife was stricken with a sad malady. This affected her husband greatly, and no doubt hastened his end. He leaves a wife, and several sons and daughters to mourn their sad loss and for whom general sympathy is expressed.

The funeral took place last Sunday and was very largely attended. The remains were interred in the Roman Catholic Cemetery at Sandon, the Rev. Father Walsh officiating at the grave. Mr. Jas. Kinross had charge of the mortuary arrangements."

Michael married Hughina Clark Ross [809], daughter of George Tulloch Ross [3737] and Christina Sutherland [3738], on 13 Dec 1870 in Castlemaine, Vic, Australia. Hughina was born circa 1853 in Sutherlandshire, Scotland, died on 27 Mar 1934 in Daylesford, Vic, Australia aged about 81, and was buried on 29 Mar 1934 in Daylesford, Vic, Australia.

General Notes: living in Raglan Street Daylesford at the time of her death. Said to have lived in Victoria for 79 years, which means she would have come into Australia c. 1855 if these dates are correct. Sometimes the surname is listed as O'Sullivan

INQUEST AT NEWSTEAD
The adjourned inquiry on the body of Daniel Sullivan was held at the Balmoral Hotel, before Geo. Smyth, Esq., Coroner. Dr Bone was examined, and stated that he was called in on Wednesday, the 8th inst., to prescribe for the child. Saw the child, and heard from the mother ,the symptoms; the child had fits for some days previously,- that was, that it was croupy ; examined the child, and the symptoms showed that hooping cough was approaching ;sounded the child, and at that time a large amount of mucus was in the bronchial tubes, and a wheezing was heard in the chest. Following out the usual practice, I ordered a cough mixture as prescribed ; the prescription now
produced is the one given by me, the action we would require ; on tasting the bottle l could not say that it does not contain ipecaccuauha wine ; it is highly charged with something else to withdraw the taste of pure wine. I am quite certain that, not only on my own but any other medical men could the prescription produce the effect that has in this case resulted. By Mr Bath : Never, heard of any injurious effects caused by an emetic, nor do I know in my own practice of this dose being iujurious as an emetic. There was no appearance of any brain disease. Miss Ross was further examined; Mr Bath put four ingredients into the bottle, and I heard, but could not swear that he did not put in the fifth. In answer to Mr Bath ; I positively swear that you mixed different ingredients, -first you put in a dark mixture but I will not swear that afterwards you put castor oil.
Dr Malcolm, sworn, examined, stated: On the 10th inst., I made a post-mortem examination. There were no external marks of injury. The upper part of the deceased's body was congested; indicative of poisoning by a narcoctic, such as opium. I examined the body; the organs were perfectly healthy. I carefully examined the throat and windpipe, and found in them no trace of disease. The brain was healthy, but the back was congested slightly, and the effusion was there, but was port mortem. The cause of death was the effusion of blood to the brain. The cause I can't give you. The prescription prescribed could not be the cause. Mr Bath has made up his prescriptions for six years, and that in fact he is my instructor as to how make up prescriptions, and has never to my knowledge made any mistake. A chemist is bound to make out the prescriptions according to instructions without any deviations whatever. I could not swear as to the content of the bottle.
By the jury: Livid congestion is not necesessary from narcotic poison. Dr Smith, sworn, stated: Was called to deceased on the 8th inst. Found the child in a decidedly poisoned state. There was stertorous breathing, and the eye fixed. Tried to give it tepid water, but the child could swallow nothing more. Knew from what I observed it was poisoning. Opium is in the bottle produced: Met Mr Bath at the Balmoral hotel, and asked him to come down to Newstead and we would examine every authority on the subject as to whether it was a poison. I was present at the post-mortem examination, and am fully persuaded that the child died from effusion on the brain ; the whole of the brain was congested, and the appearances were of narcotic poisoning.
To Mr Bath: don't remember your suggesting sulphate of zinc; in fact, the child could not have swallowed it. Mr. Bath, sworn, stated: I was never apprenticed to the chemist profession, but served with my brother, who is a surgeon, and kept a dispensary for four, years, and have been practically engaged dispensing and making, up medicine for the last twenty-five years, or there about. For about six years was dispensing for Dr Malcolm at Yandoit, Fryers, and Vaughan.
The prescription produced consists solely of stippoo wine; I made it up according to the best of my belief as directed and put it into the bottle, now produced ; I took the contents from one bottle only'97 it was marked I.P.N. Ipeccac contains about 2 1/2 oz to 3 1/2 oz, the same colour as that produced. Miss Ross is entirely wrong if she states I took the contents of that bottle produced from more than one; she must have referred to the cough mixture . I told her that I thought it should be given in water. I have tasted the contents, and cannot swear that it is stippoo wine. I cannot account for it, but have no hesitation in saying, that the medical testimony-is correct as to opium being used. I have been for five weeks with a burnt arm, and others have had access to my place. Mr Marsh dispensed for me during that time and I do not for one moment suppose he did anything to injure me. I was naturally confused, and supposed that I was wrong that I sent the anti-monial wine to counteract the effect of a wrong dose had been administered ; but after looking, found I was correct as to my instructions, The coroner summed up most undoubtedly in favour of committing Mr Bath, who made up the preparation, which was proved to contain poison, and, was not ipecaccuanha wine; as prescribed by, Dr Bone. The jury, after about an hour's consultation, found Mr Bath guilty of manslaughter with a very strong recommendation to mercy. Mr Bath Was admitted to bail in two sureties of fifty pounds each, and himself in one hundred pounds.

The Argus Melbourne 17 Oct 1873 page 5

The adjourned inquiry concerning the death of the child Daniel Sullivan at Newstead, on the 8th inst., from poisoning, was held on Wednesday. According to the evidence, as reported in the Mount Alexander Mail, the deceased had been suffering from whooping cough, for which Dr. Bone prescribed some ipecacuanha wine. The prescription was made up by a Mr. Bath, and a dose administered to the deceased, who shortly afterwards exhibited symptoms of narcotic poisoning. Dr. Smith was called in, but the child was then past medical aid. The medical evidence proved that the mixture consisted to a large extent of opium, and that the child's death had been caused by some narcotic poison. The statement of Mr. Bath was that in making up the prescription he had used the contents of only one bottle, which was supposed to contain ipecacuanha wine. He admitted, however, that what had been given to the child was opium, and not ipecacuanha. He informed the coroner and jury that he had never been apprenticed to the chemist profession, but served with his brother, who was a surgeon, and kept a dispensary for four years, and had been practically engaged dispensing and making up medicine for the last 25 years. For about six years he had been dispensing for Dr. Malcolm, at Yandoit, Fryers, and Vaughan. The jury, after about an hour's consultation, found Mr. Bath "Guilty of manslaughter, with a very strong recommendation to mercy." Mr. Bath was committed for trial, but admitted to bail in two sureties of £50 each, and himself in £100.

MANSLAUGHTER
James. Bath surrendered to his bail on the charge of killing and slaying one Dan. Sullivan on 8th October. Mr Leech, instructed by-Mr Paynter, appeared for the defence. The Crown Prosecutor stated the case, and said that it was not urged that the prisoner had any animosity towards the infant, ' but through his criminal negligence its death was caused. He then called Mrs Hughina Sullivan, the wife of Mr Sullivan, farmer of Sandon : Had a child named Daniel Sullivan, who on the 3rd of October was taken ill. Prior to that date had never been ill. On that occasion gave him ten drops of essence of linseed in warm water three times.
A day or two afterwards (on the 8th) the infant complained of being choked, and at once took him to Dr Bone at Newstead. the doctor examined the child, and gave a prescription (produced) which she, gave to her sister, Annie Ross. Witness stayed at her mother's place that night Miss Ross went to Newstead, and returning brought back two bottles, but only some of the small bottle was used, according to the directions thereon. The child got sick afterwards, and some linseed poultices were placed on the child's breast. After the third dose the child began to get drowsy, but the doses were continued for an hour, at which time symptoms of death set in. After the medicine was discontinued witness sent her sister to Mr Bath's on horseback; she was accompanied by Mr Silvester. They brought back a small bottle containing a light-coloured fluid; gave him a dose, but on the third attempt the child could not swallow it-the medicine came up through his nose. Sent for Dr Smith. Prisoner came to the house about ten o'clock, and said the first medicine should have been given in warm water. In reply to Mr Sullivan, prisoner said that if anything occurred Dr Bone was to blame. At this time Dr Smith arrived, and said that the child was most decidedly poisoned.
Mr Bath said that he had given it "ipecac".
About 12 o'clock the child got convulsive, and only lived till a quarter-past 8 next morning. During the night gave the child warm baths. To Mr -Leech:- Gave the bottle produced to Constable Dawson at the inquest; it had been kept in a drawer from the time the child died, and was in the same state as when used. Annie Ross, sister to the last witness, residing at the Balmoral hotel, Newstead, gave corroborative evidence. She had taken the prescription to prisoner, and received from him two bottles; and noticed while he was making up the small bottle that he put three different liquids in it besides water. Prisoner gave no verbal instructions how to administer the medicine. The larger bottle was not used at all. Heard all that passed between Dr Smith and the prisoner with respect to the state of the child. To Mr Leech; Observed what Mr Bath put in the bottles; had a fashion of always noticing such things in chemist's shops. The materials for the small bottle were taken out of two bottles on the counter; then heard something fall into the bottle, then poured in some water, filling up with something out of bottle on the shelf; the liquid was thick and dark; could not say if the contents of the bottle became milky. Dr Bone then deposed to the prescription be had written out for Mrs Sullivan's child at the Balmoral hotel, near Newstead. The child was suffering from mucous in the bronchial tubes,-otherwise mucous croup and cough - it was dangerous if not attended to. The child was brought to him early enough to treat it for that disease. Prescribed an emetic - ipecac wine, to be taken every ten minutes - R Conium1 1/2 drachm, compound spirits of ether one drachm, paregoric 4 drachms, simple syrup 6cdrachms, water to 6 ounces. Take one tea spoonsful every two or three hours. Knew Mr Bath, who was a chemist and druggist in the habit of making up medicines for him. Had given a child a much larger dose without injurious effects. Ipecac wine would be kept in a single bottle; the directions on the bottle were correct according to his instructions. Could not undertake to say what the bottle produced contained. Did not see the child a second time, and did not think the medicine he prescribed would have produced the effects as described by last witness '97 it would not make a child drowsy.
To Mr Leech; The symptoms might be produced by effusion on the brain; the result of natural causes. In the cough mixture there were four or five ingredients. Prisoner had always been a careful man, and was fully competent to administer medicine. Had been attending him for very severe burns on the arm, which were not quite healed up; he had been laid up for some considerable time, as there was considerable slough from the wound. To the Crown Prosecutor: Had attended prisoner until very lately. The symptoms of effusion on the brain might resemble narcotic poisoning
very closely. To a juryman: A chemist is not supposed to alter anything in a prescription, or substitute one thing for another without permission.
Dr Malcolm: Had attended the inquest on the 10th October, and made the post mortem examination. There were no external marks of violence, but lividity of the skin, indicative of poisoning by opium; did not see the child when it was alive; the symptoms were described were indicative of poisoning by opium, and could not be attributed to ipec wine, an overdose would produce a more immediate affect. The lungs and heart were health; the brain was congested. Attributed death to the congestion of the brain, but could not say if it arose from natural causes, as such symptoms would be produced by an overdose of opium. He discovered no disease at all; and the prescription would not have done any harm. From the time that elapsed from the death till the contents of the stomach were analysed, the opium would be absorbed, and would not enable any person to say that the congestion was the result of natural causes. To Mr Leech: Agreed with Dr Bone; congestions of the brain might result from convulsions. Had been acquainted with Mr Bath for 19 years; had him under his employ, and would now take him into his employ sooner than any man in the colony of Victoria; never saw him under the influence of drink while on duty. Had every confidence in him. Hugh Smith, a legally qualified medical practitioner, residing at Newstead, gave corroborative evidence. When he saw the child, about midnight, it was breathing stertorous, and he sight fixed: prescribed for the deceased. The contents of the bottle (having tasted it) were not ipec wine. At once told the people that the child was poisoned. Asked the prisoner how he had made ipec. wine and he replied that when he made ipec. wine from colonial wine, he used spirits to keep it from getting sour. Did not examine the bottle from which the medicine was taken at prisoner's shop ; know now that the bottle produced contained tincture of opium, which would produce symptoms such as those described. A child two years six months old might be teething. To Mr Leech: In his opinion death was the result of congestion of the brain, caused by opium, but he agreed with the evidence given by Drs Bone and Malcolm. The child was convulsed.
Had every confidence in prisoner, who frequently made up his prescriptions.

Mrs Sullivan and Annie Ross were called to prove that the child was not exposed to the rays of the sun in anyway, and that the prisoner was perfectly sober. Constable Ross proved having received the bottles produced, and delivered them to Mr Johnson, the Government analytical chemist. Wm. Johnston, Esq.,- Government analytical chemist, deposed to the contents of the bottles given him by the last witness, and now produced. In on he had found traces of opium in very small quantities; the prescription would account for it ; had no reason to doubt the bottle contained the ingredients prescribed ; the second bottle was subjected to a great variety, of tests ; detected morphia and micomic acid first was the active principle of opium; the proportion was 1-3 of the strength of tincture of opium or weak spirit; the third contains antimonial wine, which should operate as an emetic. A teaspoonful of the second bottle would be a fatal dose for a child, as young children were peculiarly, susceptible, to the effects of opium. The effect of ten doses would be to make the child throw- it-all off the stomach or absorb it. The effects of poison are always rapid. To His Honour: There was no ipec. wine in the second bottle; in a druggist shop the bottles are labelled ipec. and opii. and might be easily mistaken. To Mr Leech : Tested the contents of the bottle with chloride of iron, which left a peculiar colour, which no other substance did. Micomic acid was a component part of morphia. Emeting was the active principle of ipec. win. Had made eight several tests, all of which proved the presence of opium. This was the case for the Crown, and the Crown Prosecutor then addressed the jury on the evidence produced, expressing his extreme regret at seeing a man possessing such a character as that just given him by the witnesses in ; such a position brought on by his carelessness in the administering of medication. He did not think such gross misconduct should be passed over without due punishment, and argued that the evidence all pointed to the guilt of the prisoner, and it would be an insult to their common sense to put it to them that death was caused either by an accident over which he had no control, or from natural causes. He regretted that no witnesses had been called for the defence, in order to show that an error had been committed accidentally.
Mr Leech then addressed the jury for the defence. He regretted that the Crown Prosecutor had displayed such temper in the conduct of the case against the prisoner; he had always understood that the Crown sought to convict a prisoner by mere justice, and not intemperate conduct'97 the arguments he considered very futile and incongruous. For his part, he was not at the inquest, and could not explain why the prisoner had omitted to do certain acts pointed out by the Crown. He would first ask the jury if there was a prima facie case against the prisoner, seeing that the evidence was so contradictory, in fact, so much so, that the Crown had expressed, itself not willing to urge, it, Annie Ross had sworn that the first bottle was filled by four different ingredients, whereas the analytical chemist had- shown there was only tincture of opium with weak spirit. Every one of the symptoms of the deceased were quite consistent with natural causes, - congestion of the brain, caused by sun-stroke or convulsions. All the medical gentlemen, had agreed on that one point. He then proceeded to read authorities to show that the rule with regard to the degree of misconduct in dispensing medicines is whether the accused had acted without due caution, and in the whole bearing of the case there was not a scantilla of evidence to prove the allegation.
On the contrary, the evidence showed that he had always maintained a character for calution and carefulness. According to the prisoner, he could not account for the apparent mistake, but he believed even now that he had taken the contents of the bottle from one labelled "ipec,"and not from the labelled "opii." With regard to the accident, he put it to the jury that while the prisoner was ill from that cause, the bottles had been misplaced by the assistant, of which prisoner was not aware, and merely put up his hand to the accustomed place for it. Then again, there was the singular circumstance of the stomach not being sent down for analysis. In conclusion he summed up the various points of the case in favour of the prisoner, contending that there was no evidence of gross negligence or carlessness.
His Honour summed up, and observed that the prisoner was charged with mis-compounding a prescription prepared by a competent medical gentleman, and then proceeded to point out that the case was simple, as laid down in law-books. If the medicine was administered by a person
unqualified, and a mistake occurred, then he would be guilty of manslaughter; but if a properly qualified chemist by some accident gave the wrong medicine, not through gross carelessness, then they could not charge him with that misadventure, which all were liable to. He put the matter to the jury in the form of two questions - whether the ingredients of the bottle by mistake, or gross negligence, did not contain the ingredients prescribed, or whether it as caused by carelessness. He thought before he jury could convict the prisoner they must be satisfied that it was given by a culpable mistake. He quoted from Lord Lyndhurst, and left it to them to say whether the death of the child Sullivan, was caused by the gross negligence of the prisoner. The jury retired.

Although this article says Mattie Sullivan, I believe it is more than likely Mary Sullivan.

According to information from family members and newspaper articles of the time, Mary and her sister Ethel were taken to school in a buggy each day by Mr Judson, along with Mr Judson's two sons. In 1918, the Loddon River was in flood and as the buggy was crossing the river, the horse shied. The buggy tipped and the occupants in the buggy were thrown into the river. The two Sullivan sisters and Mr Judson and one of his sons also drowned, but Mr Judson's younger son was rescued. Due to the flooding in the river, searching for the bodies was delayed. Mr Judson was recovered on the 19th of June, his son on the 20th, Mary Sullivan was found on the 23rd of June and Ethel was found on the 25th of June. The Sullivan girls were buried on the 26th of June. The horse also drowned. An inquiry was held into the drownings in late June or early July 1918.

In December 2014 I searched on the National Library of Australia's Trove site and found no less than 50 articles regarding this tragic event in papers all over Australia from Western Australia to Queensland and also in major newspapers in Melbourne and Sydney. This story obviously grabbed the hearts of the country despite the fact that the first World War was still raging. The articles from the Newstead Echo were not found on Trove so I assume they are not yet digitised.

One article from the Maryborough and Donolly Advertiser dated 26 June 1918 is quite moving and states " On Saturday at midday, the body of the eldest daughter of Mr John Sullivan was found about 300 yards from the spot where the body of the young Judson was brought to the surface. A person who viewed the body stated that the appearance was altogether different from that usually associated with the condition of being drowned. The girl appeared as if she had just fallen asleep, and there were no discolourations of the body with the exception of slight bruising to the legs. The body was discovered by Mr Dave Smith."

The following articles are some that I have found regarding the tragic drowning of Mary and her sister Ethel.

Newstead Echo - 19 June 1918
"FATHER AND SON AND TWO LITTLE GIRLS DROWNED WHILST CROSSING STREAM

A sad drowning fatality occurred at Joyce's Creek yesterday morning. Mr H Judson a well known farmer of Joyce's Creek was driving with two of his sons, along with two daughters of Mr & Mrs J Sullivan to school and in crossing the Joyce's Creek, near the school, the current swept the horse off its feet and all the occupants were precipitated into the strong flowing stream and disappeared.

The youngest son of Mr. Judson kept a hold of the vehicle which was being carried down stream, and Mr H McDonald, who was close at hand ran alongside the current and plunging into the water rescued the boy by mere chance, he just gripping the strap of the school bag.

The other four bodies are not recovered, and as the river is only a short distance away from the scene of the terrible tragedy, it is feared that they are carried downstream.

Dragging operations are being carried out, but up to the time of going to press, none of the missing bodies have been discovered.

The horse also drowned."

JOYCE'S CREEK FATALITY
TWO BODIES RECOVERED.
The drowning fatality at Joyce's Creek is one of the saddest incidents of the district's history. All day long hundreds of people gather in the vicinity of the stream, among them many near relatives of the unfortunate victims. Dragging operations are continued incessantly, and willing operators in this respect are never lacking. Motor cars and vehicles of every description are standing everywhere, and the scene is one not easily to be forgotten.

Yesterday morning the body of Harry Judson the father was found close into the bank, near where the gig was discovered, and in close proximity to the railway bridge. At this point there is a deep hole, and, in the hope of recovering the bodies of the other victims, the dragging was confined to this quarter, but without success.

During the afternoon, however, the body of the boy Judson was brought to the surface a little lower down the creek. So far neither of the Sullivan girls have been recovered.

Newstead Echo - 26 June 1918
"Operations on the creek to recover the bodies (after the sad fatality of Tuesday) could not be resumed on Wednesday last to any great extent, owing to the creek being in heavy flood, an inch and a half of rain being recorded locally.

Early on Thursday the body of Mr Judson was recovered near the Railway bridge on the down stream side, very close to where the gig and pony came to a standstill.

From early until late, willing helpers arrived, trusting the results of their efforts would relieve the tension on everybody's mind. Residents of the district from miles around came, and all the menfolk of Newstead suspended their various vocations and went out in a body.

In mid afternoon at Lancaster's bridge the body of Master Bill Judson was brought to the surface. By this time over 100 people were in active search, and the boat from Castlemaine arrived and was of great assistance in the making of a more systematic overhaul of the creek, but to no avail, and Friday and Saturday the result was the same.

The body of the eldest girl (Sullivan) was recovered on Sunday in about 12 feet of water on the opposite side of Lancaster's bridge to where the boy was found. The buggy rug was also recovered from the same spot and the cushion to which the little boy Judson who was saved, clung, was discovered a little lower down the creek and not far distant, the horses halter was brought to the surface.

Very great sympathy is expressed for the bereaved widow as well as Mrs Judson Senr, of Smeaton, and Mr and Mrs Sullivan in the great loss sustained.

A large number of willing workers in co-operation with the police, are still searching, and as the three others were discovered in the creek, also the cushion etc., it is now considered that the other little girls body has not reached the Loddon.

LATE: Just as we are going to press, news has reached us that the body of the other little girl Sullivan was found in the blind creek which runs to the left of the main stream beyond the Railway bridge."

ANOTHER BODY RECOVERED.
On Saturday at. midday the body of the eldest daughter if Mr. John Sullivan was found about 300 yards from the spot where the body of young Judson was brought to the surface. A person who viewed the body states that its appearance was altogether different from that usually associated with the condition of the drowned. The girl appeared as if she had just fallen asleep, and there was no discolorations of the body, with the exception of slight bruises on the legs. The body
was discovered by Mr. Dave Smith.

At 4 o'clock the gig cushion was found about half a mile down the creek. On Monday a big party of men from Maldon assisted in the work of searching the stream for the remaining body, and yesterday two car loads from Smeaton also joined in the search.

THE FUNERAL
The funeral of the late -Mr. Judson and his son took place on Saturday afternoon, the bodies being conveyed to the Mount Prospect cemetery by motor.

Three motors followed the remains from Joyce's Creek. and at Smeaton they were joined by a number of others from all parts of the district. Over 500 people gathered in the vicinity of the grave, and the scene was most impressive. The coffin-bearers and pall -bearers in the burial of Mr. Judson were as follow :-.Messrs. R. Richardson, W.Jayes, W. Fletcher, Watkins, R. Tankard. .T. Fletcher. E. Boyd. J.Quine. T. Parkyn, A. Greeves. T. Archibald. E. Andrews, J. Pedrotti. G. May,M. Prendergast. W. Whatmore. I. Gates, W. Their remains were followed by a large number of sympathisers, over 50 vehicles being in the cortege from Joyce's Creek to the Sandon Cemetery, where the interment took place.
The finding of the little girl on Tuesday in the blind creek was unlooked for as Mr E. J. Mitchell and Mr.D. Sullivan, after searching the main creek, proceeded to The mouth of the blind creek, and had only applied the grappling rods a few minutes when they brought to the surface a piece of dress material. They again applied the rods, and were successful in raising the body. The depth of the water was only two feet.
The inquest opens on Friday.

"JOYCES CREEK TRAGEDY MAJESTERIAL INQUIRY VERDICT OF ACCIDENTAL DEATH

Mr Coutts JP conducted an inquiry in the Joyce's Creek Public Hall Friday afternoon, into the circumstances attending the drowning fatality at Joyces Creek.

Claude Watts, a schoolboy, said on the 18th inst. he was near the footbridge when Mr Judson came along, with him were his 2 sons and the two Sullivan girls. The horse became restive about the middle of the crossing. He heard Mr Judson call out "help!". He tried to turn the horse round, but failed, and the horse, gig, and occupants, went down stream. The horse then tried to get up the bank but the gig capsized. Witness went a little distance away and called for help, and Willie McDonald came.

Mr J Caulfield, State School teacher, said on hearing screams in the direction of the creek he ran down, and asked one of the boys present who was in the water, and was told that, Mr Judson, his son, and the two Sullivan girls had been capsized into the creek, the gig having been overturned. Witness saw the youngest boy Judson in the water about 50 yards downstream. He saw the horse and gig in the stream behind the boy he was following. Mr McDonald crossed over the other side of the creek, and caught the boy as he was floating down.

William Crowhurst, a railway employee, said he assisted in the search for the bodies on Tuesday, Wednesday and Thursday. He found the body of Mr Judson on Thursday at 6.50am. It was lying face downwards on a bed of silt.

James Nokes, said he assisted in the search, and recovered the body of the boy Judson at Lancaster's bridge on the 20th inst.

Harold McLeay, of Moolort, assisted in the search, and recovered the body of Ethel Sullivan, a short distance from the Railway bridge on the 25th inst. [Mary's body was recovered on the 23rd but this is not mentioned in the article nor is the name of the person who found her body]

Constable Ellis said at about nine o'clock am on the 18th inst. He was informed of the fatality and proceeded to the spot. The creek near the school is crossed by a very much exposed and dangerous crossing. A footbridge is built across the stream on the side of the road in such a way that little protection is offered. The bridge itself is not safe for children to cross. It appears that when half way across the stream, the horse became frightened. At the side of the road downstream, there is a deep hole, and no fence to protect any persons crossing. The horse, when it turned to go back, fell into the hole, and the gig and occupants were thrown into the water. He considered the occurrence was purely an accident.

Henry McDonald said he saw Mr Judson driving through Joyces Creek, and spoke to him before the accident. Shortly afterwards, he heard screams, and ran down and crossed the footbridge. He could then only see the horses head some distance downstream. He ran past the gig and horse and then saw Mr Judson in the water but he immediately disappeared. Witness continued running towards the Railway bridge, and saw two children in the water, one in the middle of the stream and the other on the opposite side. A little further on Mr Caulfield joined him, and they threw a log into the water in the hope of someone might catch hold of it. He then left Mr Caulfield, and ran across the railway bridge to get near to the children. He was then able to rescue Thomas Judson.

A verdict was returned that the deceased persons came to their death on the 18th June from drowning and the occurrence was purely accidental."

ACCIDENT IN FLOODED CREEK.
MARYBOROUGH, Tuesday.-Mr. Harry Judson, a well-known farmer of Joyce's Creek, was driving his two boys to school this morning. On the way he picked up two little girls, the daughters of Mr. John Sullivan, who also resides at Joyce's Creek.
They were crossing the creek, which was considerably swollen by the recent rains, when the vehicle was upset, and the occupants were swept away. Hearing cries from the direction of the creek, Mr. H. H. McDonald ran down to the stream near the crossing, but nothing was to be seen. Shortly afterwards, however, he discovered one of the Judson boys nearly a mile down the creek floating on a buggy cushion. As the boy drifted near to the bank Mr. McDonald hauled him out. The bodies of Mr. Judson and the three children who lost their lives, have not yet been recovered.

Messages were sent to the police at Newstead, Dunolly, and Maryborough for grappling irons, but these were not to hand till a late hour this afternoon. Joyce's Creek flows into the Loddon, and it is feared that the bodies have been carried to the river. The horse, which was drowned, and the gig were carried against an obstruction in the creek

Sullivan to school at Newstead this morning, the flood waters of Joyce's Creek swept the horse off its feet and capsized the buggy. Mr. Judson, one son, and both the girls were drowned; and the other son was rescued by a man who plunged into the creek and caught the strap of the buggy seat, to which the boy was clinging. The creek was swollen by the heavy rain which had fallen all night, and the horse and buggy were caught by the current near the school house. The youngest son, who was rescued, held to the vehicle, which was carried swiftly downstream. Mr. H. McDonald, who saw the accident, ran along the bank until he was slightly below the floating buggy, and then plunged into the water and saved the boy by a mere chance.
The four bodies have not yet been recovered. The horse was drowned, and its body has been pulled out of the creek.

General Notes: u.r. at death was 8 Weir Pl.Geelong.

The story of Julia's life is uncertain. Julia had six children and no fathers were named on any of the birth certificates. My belief is that Julia gave birth to the 6 children and family stories state that at least some of the children were raised by her parents, including Albert Frederick.

One story I was told, was that Julia was the local midwife and took unwanted babies (and presumably registered their births with her as mother). However, this story is simply that, a story, and as all births are registered with Julia as the mother then legally all are Julia's biological children..

Julia was said to have married John Snakenberg (Snakeberg) in about 1914, but no marriage registration details have yet been found. As all Julia's children were born prior to 1912, I assume that John Snakenberg (Snakeberg) was not the father of the children, but no proof exists either way. Julia appears in the 1914 electoral roll as Julia Sullivan living at Newstead. She does not appear again until 1924 when she is called Julia Snakenberg and is living in Castlemaine.

Julia's death certificate states she had no issue, but perhaps the information they were referring to her marriage.

Julia had a relationship with someone [—?—] [870]. This couple did not marry.

Their children were:

41 F    i. Eileen Maud Sullivan [869] was born in 1895 in Newstead, Vic, Australia and died in 1895 in Newstead, Vic, Australia.

+ 42 M    ii. Clarence Archibald Sullivan [871] was born in 1898 in Maryborough, Vic, Australia, died in 1978 in Balaclava, Vic, Australia at age 80, and was buried in 1978 in Burwood, Vic, Australia.

Clarence married Verna Doreen Williams [1149] (b. 1909, d. 7 Jan 1965) in 1926 in Vic, Australia.

43 M    iii. Albert Frederick Sullivan [872] was born in 1900 in Newstead, Vic, Australia, died on 7 Jul 1918 in France at age 18, and was buried in Jul 1918 in Hazebrouck, , France. Another name for Albert was Brick Sullivan.

General Notes: Albert was raised by his Grandparents. Albert altered his date of birth to enlist in World War 1. He was killed in France and was a Lance Corporal No. 4937 in the 5th Battalion AIF. On the photograph of his grave he is known as A.F.J. Sullivan. His name is also on the War monument in Newstead Victoria as A.F. Sullivan.

He was known as Brick because of his red hair.

FOOTBALLER INJURED
Castlemaine, 13th July
In the football match played on Saturday between Campbell's Creek and Newstead, Albert Sullivan, a Newstead man, collided with another player and fell, sustaining a fractured collarbone. He was attended to at the Castlemaine Hospital.

Albert travelled to Melbourne to enlist on 1 December 1915 when he was just 15 years of age. He lied about his age saying that he was 19 years and 7 months old. He was 5' 8" tall and weighed 128 lbs. He had red hair, blue eyes, and freckles on his arms neck and shoulders. He gave his occupation at labourer as he has worked on his Grandfather's farm at Newstead, Victoria. He stated on his enlistment form that his parents were dead, although his mother was well and truly alive. He gave his next of kin as his brother Archibald who was also in the AIF.

He was sent to the 3rd Depot squadron at Seymour from 7.12.1915 to 23.12.1915 and attended the Signal School at Broadmeadows. His rank was private and he was in the 5th Battalion.

He left Melbourne on the HMAT Wiltshire on 7 March 1916, via Suez and disembarked at Marseilles France on 17 May 1916. On the 2nd May 1916 he joined his base depot at Etaples. In June 1916 he spent some time in hospital in France with Pyrexia (fever). In November 1916 he was admitted to hospital with trench fever and trench feet. He was sent back to England on 7 November 1916 and spent some time in hospital. In early 1917 he went absent without leave, for almost a fortnight and was detained for 14 days and forfeited 28 days pay. He remained in England until 26 April 1917 and returned to his unit in France on 12 May 1917, after only one month he was admitted to hospital once again on 19 June 1917 P.U.O. and sent back to England on 30 June 1917 on the ship Western Australia where he was admitted to Richmond Military Hospital with trench fever. He remained in England and was admitted to hospital at Sutton Veny again on 20 November 1917 with septic dermatitis. He remained in hospital until 18 December 1917. On 12 January 1918 he was charged with breaking off parade without permission and making a false statement to an NCO at Sutton Veny. On 7 February 1918 he returned to France via Southampton and rejoined his unit on 12 February 1918. He was promoted to Lance Corporal on 2 June 1918 and on 7 July 1918 he was killed in action in France at the age of 18.

He is buried at La Kreule British Cemetery, 3/4 mile due north of Hazevrouck France, Plot 2, row F2. His personal effects were returned to his Grandmother, Mrs D J Sullivan of Newstead on 26 August 1918.

La Kreule is a small hamlet 2 kilometres north of Hazebrouck, on the road to St Sylvestre-Cappel and Steenvoorde. Leave Hazebrouck on the D916 heading north. The Cemetery is visible from the roundabout where the D916 crosses the Hazebrouck by-pass. The access road to the cemetery is 100 metres off the roundabout, on the left hand side.

Historical Information: La Kreule Military Cemetery was opened in April 1918 by the 1st and 2nd Australian Casualty Clearing Stations, which came back from Outtersteene ahead of the German advance, and the 17th, which arrived from Lijssenthoek. These three stations, known collectively as "Ana Jana Siding", were posted to the north of La Kreule, but in the middle of April they withdrew to Blendecques, near St. Omer, and the cemetery was then used by heavy artillery and fighting units. In October 1918, the 17th Casualty Clearing Station returned with the 8th and the 64th and the cemetery was closed at the end of the month. The cemetery contains 576 Commonwealth burials of the First World War and 11 German war graves. The cemetery was designed by Sir Herbert Baker. (information from the Commonwealth War Graves Commission)

By 30 January 1920 Albert's mother, Julia Sullivan, now known as Snakenberg, had proved that she was in fact his next of kin. Albert was awarded the 1914/15 Star, the British War Medal and the Victory Medal. A memorial scroll was sent to Julia on 2.2.22 as was a pamphlet entitled "Where the Australians Rest" as well as a Memorial Plaque. The Victory Medal was sent on 19.2.1923 and the British War Medal on 14.11.1924.

Newstead Echo-Wednesday July 24th 1918
"The sad news was received on Saturday evening that Pte Albert Sullivan was killed in action in France on July 7th. The fallen soldier was only 18 years of age in last April and was 2 1/2 years fighting. Enlisting in Melbourne at the age of 15, he presented such a manly appearance that he passed as 21. Deceased had his 16th birthday while on the water. "

46 M    vi. Allan Edward Sullivan [875] was born on 18 Feb 1912 in Newstead, Vic, Australia.

General Notes: informant Albert Sullivan brot.

Allan Edward is the youngest child of Julia Hannah SULLIVAN. I have found no further information on Allan. Allan's mother Julia had 6 children, one of whom died shortly after birth, the next four (all of whom were sons) I understand were brought up as children of Julia's parents Daniel and Mary Jane Sullivan but there is no information on Allan who was born 8 years after the previous child.

Albert Sullivan, brother was the informant on the birth registration. I am unsure if this is Albert Frederick, Julia's son b. 1900 but it is more likely Albert George, Julia's brother b. 1877.

Julia next married John Henry Snakenberg [815], son of Henry Snakenberg [1147] and Mary Cleary [1146], about 1914 in Castlemaine, Vic, Australia. Daniel enlisted in WW1 in Melbourne on 8 January 1916. He was 35 years 6 months of age when he enlisted in the Field Artillery Reinforcements. His enlistment records show he was born in Newstead, his address was Newstead and he was a labourer. His height was 5' 8 3/4", his chest was 34-38. His complexion was described as fair, eyes grey and hair (streaky) brown. His Service number was 14630 22552. I am unsure why two service numbers appear in his records.

General Notes: Annie was born at Newstead. The legal certifier of the birth was a Mrs Sullivan. Mrs Sullivan appears to have certified many births in the Newstead area, so possibly she was a midwife. Unfortunately her first name is not known.

Annie lived on a fruit block no. 496 at Red Cliffs until after her husband's death. She then moved into Red Cliffs. In 1952 she moved to Mildura where she ran a boarding house, but she later returned to Red Cliffs where she lived at 32 Laurel Street until her death. MINER CRUSHED TO DEATH.
Fall of Stone.
DAYLESFORD. Wednesday - Daniel Sullivan, aged 41 years, a miner, residing in Vincent street, Daylesford, lost his life on Tuesday night in the Ajax North mine. He was working a boring machine in a rise from the south drive at No. 8 level, and was alone, the nearest workmen being some distance away. He had gone on at 4 o'clock in the afternoon, and at crib time at 8 o'clock had joined two other miners, Michael Sullivan and Ernie Yanner, in the level. Soon after the resumption of work he came down from the rise to get a pick, and that was the last time he was seen alive. At about half-past 11 o'clock Yanner noticed the sound of the air blowing off at Sullivan's machine, and called out up the rise to him. "What's up?" As he received no reply, he went up and found Sullivan beneath a big block of sandstone which had come away from above, only his head and one arm being exposed. He summoned assistance, but so heavy was the block of sandstone that screwjacks had to be used to raise it off Sullivan. He was found to be dead. An inquest will be held on Thursday. Deceased, who was a native of Newstead, leaves a wife and a family of five young children.

Mr Daniel Sullivan, aged 43 years, of Vincent Street, Daylesford, a well-known and highly esteemed resident, was killed by a fall of sand stone in the Ajax North mine on 2oth April. Deceased leaves a wife and family,(one son and four daughters,) the eldest being 12 years of age, and the youngest a few months old. The Late Mr Sullivan was a son-in-law of Mr and Mrs Ed. Kelly, of Leahy Street.

Daniel married Charlotte Cook Clark [834], daughter of Mary Ann Cook [3736], on 16 Jul 1906 in Bendigo, Vic, Australia. Charlotte was born on 26 Oct 1881 in Sandford, Vic, Australia, died on 7 Mar 1947 in Nhill, Vic, Australia at age 65, and was buried on 9 Mar 1947 in Nhill, Vic, Australia. Other names for Charlotte were Charlotte Clark and Charlotte Cook.

General Notes: The descendants were told her name was Charlotte Kelly. Marriage certificate states her name as Charlotte Clark and her parents as John Clark and Mary Cook her husband's death certificate also has her named as Charlotte Clark. Her daughter Mary O'Connor was the informant on Charlotte's death certificate and gives Charlottes parent's names as Edward Kelly and Mary Cook.

Charlotte was born in October 1881 and in November 1881 her mother aged 19 years, married a 40 year old widower named William Best. It would appear that this marriage was short lived. In 1884 Charlotte's mother had the next of her additional 11 children. All of those children were registered at birth with the surname of Best, however the fathers name was always listed as unknown. William Best died in South Australia in 1912 and Charlotte's mother married Edward Kelly in 1910 in Bordertown, SA. On the marriages that I have found of the Best siblings, the females were married under the name Best, but the males all married under the name of Kelly and all the deaths that I have found of the Best siblings have died with the surname of Kelly and with Edward Kelly named as their father.

I have found an obituary for Edward Kelly which states he arrived in Nhill in 1884 so it is possible that Edward Kelly was the father of Charlottes 11 siblings.
