MATTHEWS - HERON
The marriage of Elleanor Patricia Heron, the elder daughter and step-daughter of Mr. and Mrs. Reg Hosie, Botany Street, Morwell, to Alan A. ("Mick") Matthews, eldest son of the late Mr. W. Matthews and Mrs. Matthews, Morwell, took place on December 16 at the Sacred Heart Church, Morwell. The celebrant was the Rev. Fr. Dwyer.

The bride looked very charming as she. entered the church on the arm of her father. Her beautifully trained gown was of ivory satin and was cut on classical lines; her embroidered tulle veil was held in place by a coronet of orange blossom, and she carried St. Joseph lilies. She was attended by her sister, Miss Clare Hosie, and the Misses Marie and Joan Drew, of Sale, who were all frocked alike in rose pink organdie and wore pretty pink lace halos and carried pink carnations and delphiniums. The bridegroom was attended by his cousin, Mr. Allan Wright, as best man, and Mr. J. Halstead (uncle of bride) and Mr. L. Berryman as groomsmen. The organ music was supplied by Mrs. J. Bridgeman and during the signing of the register the hymn "O Salutaris" was beautifully sung by Mrs. O'Callaghan.

A reception was held in the Masonic Hall, where about 50 quests were entertained. Later the happy couple left by the evening train to spend a honeymoon in Ballarat, the bride travelling in a dusty pink frock with white accessories and wore a shoulder spray of frangipani. Their future home will be in Dandenong.

DAMAGE BY BUSH FIRES.
Caused by Carelessness.
£499 Damages Awarded.

On February 11 a large tract of country in the Kangaroo Ground and Diamond Creek districts, was swept by a bush fire, and considerable damage was done to fencing and buildings. Among the farmers over whose properties the fire passed was Robert Crowsdale Bourchier, grazier, of Kangaroo Ground.

Before Deputy Judge Foster, at , Melbourne on Friday, Bourchier brought an action against Murdoch Alexander Hewitt, contractor, of Diamond Creek,' and Jonathan Hewitt, of Diamond Creek, farmer, claiming £499 for damage to property said to have been caused as the result of defendants' negligence in permitting a fire which had been lighted by either or both of them in an adjoining paddock to remain. Bourchier claimed that an area of 561 acres of grass on his properly and 1,849 fencing posts were destroyed, four miles of fencing wire was damaged, and a quantity of cut and uncut fire wood was burnt. In addition, a saw bench was destroyed, and an oil engine was damped.

The case for Bourchier was that on February 9 both Hewitts, who were father and son, were carting wood out of a paddock two miles from Bourchier's property. At midday they lighted a fire to boil a billy for the midday meal. They left the paddock later in the afternoon without having extinguished the fire properly. About 4 o'clock a fire broke out near the place at which the Hewitts had boiled their billy. Neighbors fought the fire until exhausted, and help was obtained. The outbreak was held in check. Next day the fire was still held in check, but on the morning of February 11 a northerly wind sprang up and the fire swept over a wide tract of country, taking Bourchier's properly in its path.

Bourchier alleged that insufficient care was taken by the Hewitt's to see that their fire was properly extinguished; and that the bush fire was caused by their carelessness. Evidence given by both Hewitts (was that when they left the spot at which they had their -midday meal they stamped out the fire effectively. The bush fire could not have sprung up from that point.

Deputy Judge Foster said that the evidence showed that there was a track of fire through a grass area from the point at which the Hewitts had boiled their billy to the scrub country which eventually was swept by the larger fire. It had been suggested that the bush fire might have been caused by the carelessness of some other persons, but he was of opinion that there was something more than coincidence in the billy fire, the track therefrom to the heavier scrub, and the resulting bush fire.

I am satisfied," continued Deputy Judge Foster, "that the fire lighted by the Hewitts on February 9 caused the conflagration which was quelled on that day, but which broke out again on the Friday. The defence was that the billy fire was effectively stamped out, but I am satisfied that it was not. The surrounding country was of a highly inflammable nature, and, moreover, it was the middle of summer. Experienced persons should have known of the great danger. I think that the Hewitts were guilty of gross carelessness in the circumstances. People who light fires in the summer time in country covered with grass, and who do not take elaborate precautions to extinguish their fires, are guilty of great negligence. Both the Hewitts knew that within a few chains of the place where they lighted their fire there was a reasonably safe place for such a fire in the bottom of a dry dam. They had a water-bag containing water, which they might have used to ensure that their fire was quite extinguished.

Judgment was given for Bourchier for the damages claimed,with costs.

A case of importance to people who are an the habit of lighting a fire to boil the billy came before the Eltham Court on Tuesday last, and had reference to the big bush fire at Watson's Creek on February 11.

Murdock Alexander Hewitt was charged by the police that on February 9 he lit a fire and ignited inflammable material at Watson's Creek, thereby causing destruction to property belonging to other people. He pleaded not guilty. Senior-Constable Ripper, who prosecuted, said thousands of acres of grass had been burnt that week and several houses. Accused had told the police he had lit the fire, but did not put it out, because he, thought it was out.

Joseph Jas. Stevenson, fireman, of Kangaroo Ground, said he was joint owner of a paddock in Harrington's old paddock, at Watson's Creek. On February 9 he and his brother saw the fire, and he saw two of the Hewitt's, but could not swear that the defendant was the man he saw. He went to the fire, and he and others checked it, a patch of about 50 yards being burnt. The fire was in their paddock that day, and about 60 or 70 acres of grass and timber were burnt. It broke out the next day at 10 a.m. Hewitt had permission to get firewood from the paddock. There are three Hewitt's, and he did not know their Christian names. Other men get wood from the paddock. The fire got to the crown on the rise on the 11th.

Henry Qualtrough, carter, of Wattle Glen, stated that he was in Stevenson's paddock on February 9, and saw three men going down the range. He saw defendant and his father about 3.30, who were taking wood cut. When he got home he saw smoke. He was not in the paddock where it was. He did not know the three men, who had black coats on. They were not any of the Hewitt's.

Constable Hope, of Diamond Creek, said he saw defendant in Diamond Creek. He told him he had lit a fire to boil the billy, but did not put it out, as he thought it was out. Witness examined the place where the fire was, and saw manure and chaff about. Hundreds of men were out that week fighting fires.

Counsel for defendant said there was nothing to connect him with the fire that was raging afterwards, as he tramped the fire out that he had made. Murdock A. Hewitt, wood carter, of Diamond Creek, stated that on February 9 he was with his father io[at] Stevenson's paddock carting wood. At 12.30 they lit a fire and boiled the billy in a cleared spot ; the day was warm with a south breeze. They had lunch, worked an hour or two, and left. He tramped the fire out, but did not put water on it. They left at 3 p.m., and there was no sign of fire when they left. He noticed fire about 4.30 when going home ; they were then 2 ½ miles away. He never went back to the fire. It was put out, and did not break out again till the 11th ; there was no sign of fire on the 10th. They made their fire in the gully, the usual camping place. There was no water about. There was some horse manure there. The fire was made a mostly of bark. He thought he was entitled to boil the billy if he was not burning off. He would not swear that the fire he saw 2 ½ miles afterwards was in Stevenson's. He was at the fire on the 11th at Panton Hill. When Constable Hope delivered the summons to him he said he was a fool to make the fire, but did not say he was the cause of the bush fire.

Jonathan Hewitt, father of accused, said they had camped at the spot five or six times. His son told him the fire was out. Witness had a look himself, and there was no fire when they left at 3 p.m. He saw smoke about 4.30 or 5. The spot where they boiled the billy was burnt three months ago. He would not say it was possible to put a fire out without water. What fire can be left from twigs? There was no manure about.it. They were about four miles away when they saw the fire.

The P.M. said the fire was left carelessly, and imposed a fine of £10 or two months' imprisonment. The Bench consisted of Mr. T. B. Wade. P.M., and Messrs E. C. Leach, C C. Wraight, and A. H. Price, J's.P.
