John and Helen were married at St Peters Church of England, Eaglehawk by William Eglinton. Witnesses to the marriage were William Henry Perrin and Phoebe Kidd.

WHAT CONSTITUTES LEGAL
CRUELTY?
At the City Police Court yesterday, before Mr. Patterson, P. M., and Mr. McGowan, J.P., Ellen Jones proceeded against her husband, John Elijah Jones, a well-to-do farmer and grazier, living at Mystic Park, between Kerang and Swan Hill, for maintenance.
Mr. Kirby, for the plaintiff, said that his client had been treated in such a manner that she was afraid of him, and had left the house.
Mr. Tatchell, for the defendant, remarked that the husband was willing to take her back to her home and treat her in a proper manner; therefore the case must be dismissed. The defendant was then placed in the witness-box, and stated that he was willing to take his wife and three children back to his home, which was a comfortable one.
Cross-examined by Mr. Kirby: The house - a four-roomed weatherboard one - had no fireplace, but there was one 19 yards away. He told her, after she had done the "disappearing trick so neatly," that he did not want her again, but he wanted the children. He denied having said that if he got her back he would lead her the life of a dog. She had a hot temper, and he had struck her, as she
would not " shut up" when he told her.
Mr. Kirby said that the wife was justified in leaving the house, and that the justices could make an order for maintenance provided that they were satisfied that the offer of the husband to give her a home was not a genuine one.
Samuell Mitchell, who had been Iiving at the defendant's house for the last five years as a laborer, swore that after Mrs. Jones left the house, the defendant asked him if he had seen anything suspicious between her and a man named Riley. Witness replied "No," and he then asked him if he had seen or heard anything between him and Mrs. Jones. Witness replied that he bad, and the defendant wished him to promise that he would say nothing about his having threatened to shoot her. Witness refused, and said he would tell the truth. The defendant had told witness that if he got his wife back he would "lead her a dog's life." He also said, "Now she's gone she can - well go ; I'll soon get another one here." Witness had heard him tell her to go away, and that she if she paid him the four guineas he paid for her (meaning the marriage fee, etc.). He had never heard the plaintiff use bad language, but they had not lived happily together.
Thomas O'Dwyer, a lad who had been in the employ of the defendant for seven months, stated that he had heard him threaten to blow out his wife's brains. He said he did not want her to return home.
Mrs. Jones, in her evidence, swore that her husband, had treated her brutally. He had on three occasions threatened to shoot her, and on one occasion, a few months ago. struck her behind the ear with his clenched fist. This had caused clotted blood to issue from the nostrils at times ever since. She was now being attended by Dr. McKee. He had compelled her to get up at daylight, and, with a gun, stand all- day in the fields, to keep the birds away from the crops. In addition to this, she had to do her household work but he never appeared to be satisfied. When confined, she was not properly nourished, and had not lived happily with him since he wanted her to mind sheep about five years ago. He had 5000 acres of land, 1400 sheep, also Implements, etc. He had acknowledged that she made £70 a year with butter. She denied that she had an open purse, and could spend what she liked. She had to account for every penny, and was compelled to take in washing to raise some money for herself. He even "borrowed" this money from her, and would not return it.

J. BL Curnow, accountant in Messrs. Connelly and Tatchells office, gave evidence that he interviewed the plaintiff, who refused to go back to her husband.
In conclusion, Mr. Patterson, briefly said: It's a very serious thing. Jones makes the offer that he will treat her properly, and if he does not behave properly to her she will have to take other steps. The case is dismissed.

TOPICS OF THE DAY.
Dr Madden made an application to Mr Justice Webb in the Practice Court this morning upon behalf of John Elijah Jones, of Mystic Park, near Kerang, farmer, for a writ of habeas corpus directed to Helen Jones, requiring her to bring before the Court their three children for the purpose of having them restored to the applicant. It is alleged that on the 15th of May, 1891, Mrs Jones left her husband's place with their three children without permission, and had remained away at her parents' place near Bendigo, refusing to return home or give up the children, though repeatedly requested to do so. His Honor granted the application, and made the writ returned on Wednesday next.
John died in 1913. An inquest was held into John's death. John had been in poor health for many years. He was sitting on his front verandah at Swan Hill on the evening of his death. A man he knew, Thomas Butterworth, walked past and John invited him to come and have a chat. John's wife came onto the verandah and gave John some medicine. He then fell over backwards and said he needed a doctor. John and Ellen's son in law, James Attrill was also present at the time. Thomas Butterworth claimed that John said "I'm poisoned", however, Thomas admitted that he knew John had been taking this medicine for a couple of weeks. His wife explained that he had seen a Chinese doctor who had prescribed the herbs which she brewed and John drank daily. The concoction was sent to a pathologist, who subsequently analysed same and found it to be a herbs that resembled those used by the Chinese for medicinal purposes and stated that he found no substance of a poisonous nature. Unfortunately the last page of Ellen's evidence to the court is missing.
The inquiry was held into John's death, at Swan Hill on 4 February, 1913 before John Ramsay JP, Deputy Coroner.

FOXES AND THE SMALL MAN.
Mr J.E. Jones, of Howell Farm, Balranald, referring to Mr W. J. Gallagher's letter concerning foxes in the Mudgee district, gives his personal experience of the past. Quote:-
Last year I lost about 30 lambs through the foxes, so this year I thought it well to lay a few baits before lambing time, hoping to get three, or at most four, of the vermin.
I killed a sheep, drew the paunch and laid baits about four chains apart. Next morning 1 got two. Every morning afterwards for three weeks I went round the trail laying fresh baits of fat and during that time I secured 45 foxes. All these wore caught in one paddock of 500 acres with station country adjoining on both sides ; and still they come! I asked the manager of the station to allow me to poison on his paddock adjoining, but he refused. All the squatters about here harbor them, saying they do no harm; but it is the small man who suffers all the time. The squatter may not miss, a thousand or two lambs, but it is different with the small man with his little flock of 300 or 400 sheep. The foxes will be as great a curse as the rabbits in time if steps are not taken to stop the increase. I remember some years ago a man giving a pig for twenty rabbits to turn out on his paddock, and he would prosecute anyone caught, killing one. To-day that man would give more than twenty pigs to get rid of the rabbits. So it will be with the foxes. Later on they will go in packs and kill all before them.

Mr, J. E. Jones, of Howell Farm, near Balranald, writes to say that since his last letter on the subject of foxes he has taken out of his sheep paddock 105, and yet they seem as thick as ever. This lot was taken out of 600 acres of box country. I also note in the 'Farmer and Settler,' says Mr. Jones, that foxes are taking the tongues out of sheep and that they had even tackled calves. They will do the same here soon, as they are very numerous; and I think the government or the p.p.board should make it compulsory upon every one to kill his share. Yet we hear some people still declaring' that the foxes do no harm, and only kill rabbits!

Mr. J. E. Howell, of Howell Farm, near Balranald, N.S.W., kindly writes:
-My cousin, *Mrs. Margretta Dore, of Cottesloe, sent me a copy of the "Western Mail," and I see that "New Chum" is asking for information re searing lambs' tails. I will give "New Chum" my experience, which gave very little trouble, and no loss of lambs. I just cut the tail off as usual, but had two pieces of bent hoop-iron in a fire, and, as I cut the tails, off, I just put the hot iron on the .vein under the tail, alt does not take a second to do, and it will suit any man with a small mob of lambs. Of 300 lambs done this way there was not one lost, and in the yard that held them there was not a cup of blood ; besides, the lambs showed no effect after they were done, being just as lively as when put into the yard. Also, if any of your subscribers desire any information on different sorts of wheat, I will be glad to give it to them, as I am a grower of different sorts, which I sent over to Mr. H. I. Ranford this season, and he has them on view at his office. Later on I will tend you a method of stopping a mare from slipping her foals, as I have bred a good many horses, and this treatment may be handy to some of your subscribers.

A PIONEER'S DEATH.
The Late Mrs. William Glanville.
The death occurred at Cottesloe on Friday of Mrs. William Glanville, wife of Mr. William Glanville, at the age of 85 years. Born in County Cork. Ireland. Mrs. Glanville arrived in Western Australia, with her father, Sergeant William Glanville. and family on the ship First Pyrenees. in November, 1851, and at her death had spent 81 years in this State.
Mrs. Glanville married three times. Her first husband was Mr. William James Edwards, of Essex, England. After residing at Perth for six years they sailed north on the schooner Wild Wave to Port Gregory, where they landed and proceeded overland to Murchison House station and later from there to Northampton, Geraldton and Glengarry station. In 1879, at Geraldton, her husband died, leaving her with five children. In 1880 she returned to Perth, where she resided for a number of years, subsequently moving to Cottesloe. Some years later she married Mr. Philip Dore, of Oxford, England, having one child, a son. Again becoming a widow, she later married Mr William Glanville.
Mrs. Glanville wrote many short stories and poetry, and during the South African and Great War was an energetic worker, making many useful presents for the men proceeding, overseas. Endowed with a generous disposition, throughout her long life she was always willing when called upon to help those in need and was affectionately regarded by her many friends. She is survived by her husband, three sons, one daughter, 32 grandchildren and 20 great grandchildren. The funeral took place on Saturday afternoon in the Presbyterian portion of the Karrakatta Cemetery, the Rev. T. Gibson officiating.

On the 1871 marriage certificate, Frederick is listed as a widowed in 1858, he was aged 44 and Elizabeth Jones was listed as spinster aged 40. Elizabeth's occupation is given as servant. Elizabeth's parents are listed as John Jones, carpenter and Mary Owells, the H being left off on the certificate. They were married at St Patricks Cathedral in Melbourne and witnesses to the marriage were possibly J S Vanderslade and Michael Foley.
It would appear that the children listed on Elizabeth's death certificate were her biological children, but although born before their marriage, all registered births and death have these 4 children with Frederick and Elizabeth as their parents. Though registration of births for the first 3 children have not yet been found. Frederick's occupation is given as policeman.

George Jones served in World War 1. His parents lived at Vienna Cafe Kerang when he enlisted on 19 April, 1917. He had previously been rejected because of his height (5' 1"). He was a private no.3418 in the 59th Battalion. He was later transferred to the 14th Battalion. He left Australia in July 1917 from Sydney of the SS Port Melbourne & landed in Liverpool England on 16.9.1917. on 17.9.1917 he marched to 15th Training Battalion at Hurdcott Wilts. On 23.1.1918 he was sent sick to Clearing Hospital, Codford Wilts and later that day was admitted to the 1st Australian Dermatological Hospital at Bulford, Wilts. On 1.2.1918 he was discharged from that Hospital to Convalescent Training Depot, Parkhurst, Hants. He then went to No. 1 Command Depot at Sutton Veny, Wilts from there to 15th Training Battalion at Codford, Wilts (part of 3rd Training Brigade).
On 31.3.1918 he proceeded overseas to France to reinforce 14th Battalion and arrived at the AIF Base depot at Le Havre, France on 1.4.1918 on marched to the 14th Infantry Battalion on 5.4.1918. On 13.5.1918 he was wounded by gas and was taken by 13th Australian Field Ambulance to 5th Casualty Clearing Station and from there to 41st Stationary Hospital at Amiens, more than 40 miles from the frontline. He was discharged from Hospital on 14.6.1918 and rejoined his unit on 24.6.1918. He was treated by the 12th Australian Field Ambulance on 19.8.1918, admitted to 1st Stationary Hospital, Rouen, France and then to 39th General Hospital, Le Havre. He was discharged from hospital on 11.10.1918 but was re admitted at Le Havre on 22.10.1918. He was discharged on 26.10.1918 and went to AIF Base Depot ex Contact Camp and marched to his Unit on 2.11.1918. He was then placed on Escort Duty on 15.3.1919. He marched out to return to Australia with Quota 46 on 2.5.1919 but was admitted to hospital with scabies to the 39th General Hospital at Le Havre on 5.5.1919 and was discharged on 9.5.1919. He then returned to England and embarked for Australia on H.T. Frankfurt on 1 7.1919. He arrived in Victoria, Australia on 20.8.1919.
Much of his time during the War he fought in the Villers Brettoneux region of France, also at Aubigny where the 14th Battalion undertook the "Hamel Offensive". He was also stationed at Cabaret, Morcourt, Herbonierres, Cardonette, Hangest, Brancourt, Prisches, Sains, St. Aubin, and Hanzinne, France.
He enlisted in World War 2 in the CMF to southern Signals Command on 10.4.1942 whilst living at 63 Beveridge St., Swan Hill. He enlisted in the AIF in July 1942 and his address was given as 117 Miller St., North Fitzroy. He served in Victoria, New South Wales and the Northern Territory. His service no. was VX85737. He was discharged due to ill health on 2.7.1945.
He was awarded 3 medals for WW1 service, these were 1914/15 Star No. NE, British War Medal 3/68 no.67975 and Victory Medal no.65305. He was awarded 2 medals for WW2 these were the War Medal and Australian Service <@Military*copy_held> Medal.

Also known as George or possibly John HOWELLS. According to John's death certificate he had lived in Victoria for 55 years and NSW for 1 year. If that information is correct it would make his arrival in Australia approximately 1842 and his date of birth approximately 1823. It also says that John was born in Saltash, Cornwall, England. On his son's death certificate John's name is given as John George Jones.
After much searching I was unable to find the entry into of Australia of John Jones. I put this down to the fact that there were so many John Jones's and I could not pick which one he may have been. John's occupation was recorded as brick maker on his marriage certificate in 1859, in 1885 and 1895 his occupation was recorded as woodcutter. His marriage certificate stated that his parents were Elisha JONES a sergeant in the Army and his mother Mary GLANVILLE. I decided to research this information in England and hired a researcher in 1994. He was unable to find any Elijah JONES in the regiment stated on his sons marriage certificate, or in fact any soldier by that name.
Many years ago I had been told a story by Lorna GIBSON (Nee JONES). She told me that her father, George, had told her (more than once) that the family name was not JONES at all, that was as she remembered it, OWL and that the family was Welsh.
My research commenced in the 1980's pre Internet and so all research had to be undertaken by researchers in various countries who made contact via snail mail. Back in the early 1990's I was using a researcher in England to assist in the search for information. When the researcher drew a blank looking for JONES, this story came back to me and I contacted him again suggesting he look for the marriage of Mary GLANVILLE to a soldier whose surname was something like HOWELL.
This he did and amazingly, he found what we were after. He found the marriage of Elisha HOWELLS to Mary GLANVILLE at Stoke Damerel, England on 6 November 1820. John was born c. 1826 and Elisha died on 17 April 1827 and was buried on 20 April 1827 and had been living at Bache Mill. Elisha was 39 years of age when he died and was a retired Army Officer. It is assumed therefore, that John was his son. The English researcher then set forth to find John's birth, but alas, he turned up no births to Mary GLANVILLE and Elisha HOWELLS, but found one baptism, that was George HOWELLS who was baptized on 11 September 1825, son of Elisha and Mary HOWELLS, Diddlebury, Labourer.
In April 2013 I was going through some old research information and discovered that John's son, John Elijah (Elijah John) named one of his daughter's Harriet Howell Jones, and another one Olive Charity Glanville Jones. It would appear that the story that was passed down over the years is in fact true, and that John Elijah knew this as he used Howell (His father's REAL surname and his grandfather's surname) as the second name for one child and Glanville (his grandmother's surname) as a third name for another child. This would seem to confirm my hypothesis of earlier years.
It is assumed that George HOWELLS and John JONES are in fact the same person, although this will probably never be confirmed. The reason he felt it necessary to change his name at all will probably also remain a mystery. We are perhaps fortunate that he passed on the fact that he had changed his name to his sons and grandchildren or we would never have got past the assumed name, John Jones at all.
Research ceased in England due to the difficulties in finding any further information in the mid 1990's. But assuming that Elisha and Mary HOWELLS are the correct parents I have obtained their marriage certificate and also Elisha's army records.
I was in contact via E-mail from 1997-2000 with Richard Howells, of Sandbach, Cheshire, England who is a relative of Elisha Howells and Mary Glanville. He has also tried to find a connection, but has been unable to do so but agrees with me regarding the relationship.
John and Mary were married at the residence of the of the Congregational or Independent Church Minister in Melbourne, Thomas O'Dell. The witnesses to the marriage are almost indecipherable, but may be John Witing and May Kovacs.
In view of the death certificate that indicates that John had lived in Victoria for approximately 55 years at the time of his death, I have searched for a George Howell/s arriving in Australia and have found a George Howell who was tried for larceny in Lancaster on 2 March 1841 and was sentenced to 7 years transportation. He arrived in Van Diemen's land on the Ship Barrosa. By 1849 George is listed as "free" and this is a possibility. These details were found on Findmypast.com.au.
There is also a George Howell who arrived as an unassisted passenger in Geelong on 24 Dec 1849 on the ship the Andromache which sailed from Plymouth. Unfortunately there is no age or any other details which might help identify this as the correct person.
Mary's death certificate in 1899 states that John and Mary had 2 deceased male children and 1 deceased female child. Of these children, only Mary is known, though birth or death records have not been found. The 2 male children have not been traced to date.
